Pay TDS on Property with Form 26QB: Step by Step Process
How to Download 26QB: A Complete Guide for TDS Payment on Property Sale
If you are buying or selling a property worth more than Rs.50 lakh, you need to know about Form 26QB. This is an online form that you have to fill and submit to pay tax deducted at source (TDS) on the sale of property. Filing this form is mandatory as per Section 194-IA of the Income Tax Act, and failing to do so can attract penalties and interest. In this article, we will explain what is Form 26QB, who should file it, when to file it, how to fill it, how to pay TDS online, and how to download Form 16B, which is the TDS certificate issued by the seller.
What is Form 26QB and why is it required?
Form 26QB is an online statement cum challan form that is used for paying TDS on the sale of property. It contains all the details of the property transaction, such as PAN of buyer and seller, address of property, amount paid or credited, date of agreement, TDS amount, etc. The buyer has to deduct TDS at the rate of 1% of the total consideration (excluding GST) and deposit it with the government using Form 26QB.
The purpose of Form 26QB is to ensure that tax is collected at source from the income arising from the transfer of immovable property. This way, the seller cannot evade tax on the capital gains arising from the sale of property, and the buyer can claim credit for the TDS paid while filing his income tax return.
Who should file Form 26QB and when?
Any individual or Hindu Undivided Family (HUF) who is buying a property from a resident seller for a value exceeding Rs.50 lakh has to file Form 26QB and pay TDS on behalf of the seller. However, if the buyer is a company, firm, trust, or any other entity, then they have to file TDS return in Form 27Q instead of Form 26QB.
The due date for filing Form 26QB and paying TDS is within 30 days from the end of the month in which the payment or credit is made to the seller. For example, if you pay Rs.10 lakh as advance to the seller on 15th June 2023, then you have to file Form 26QB and pay TDS by 30th July 2023.
